Terms and Conditions for Digital Download Purchases

Please read these Terms and Conditions carefully before purchasing any digital content from mumbaihikers.org. By completing a purchase, you agree to be bound by these terms.

 

1. Scope of Agreement

 

These Terms and Conditions govern the sale, purchase, and use of digital products (including, but not limited to, e-books, downloadable guides, digital maps, checklists, etc.) purchased through mumbaihikers.org. They form a binding agreement between you (“the Buyer” or “the User”) and mumbaihikers.org (“We,” “Us,” or “Our”).

 

2. Digital Download Licensing and Usage

 

 

A. Grant of License

 

Upon successful payment, we grant you a non-exclusive, non-transferable, revocable license to download and use the digital product for your personal, non-commercial use only.

 

B. Prohibited Uses

 

You are strictly prohibited from:

  1. Sharing, distributing, or reselling the digital file in whole or in part.
  2. Modifying, adapting, or creating derivative works from the digital product for distribution or sale.
  3. Uploading the digital product to any public website, forum, or file-sharing service.
  4. Using the digital product for any commercial purpose without our explicit written permission.

Unauthorized use or distribution is a violation of copyright law and will be pursued legally.

 

3. Payment and Delivery

 

 

A. Payment

 

All payments must be made using the methods specified on the website. Prices are listed in the currency specified (e.g., INR) and include any applicable taxes unless stated otherwise.

 

B. Delivery

 

Upon successful processing of your payment:

  1. You will receive a confirmation email containing a unique download link(s) for your purchased product(s).
  2. The download link(s) will typically remain active for a limited time (e.g., 48 hours) or a limited number of downloads (e.g., 3 downloads), whichever comes first. It is your responsibility to download and save the file to your personal device immediately.
  3. We are not responsible for re-sending files if the download access period has expired.

 

C. Technical Requirements

 

It is your responsibility to ensure you have the necessary software and hardware to open, view, and save the digital product (e.g., a PDF reader, sufficient storage space).

 

4. Cancellation & Refunds Policy (No Refunds)

 

All sales of digital downloads are final and non-refundable.

 

A. No Cancellation

 

Due to the immediate and irrevocable nature of digital content delivery, cancellation of an order is not possible once the payment is processed and the download access has been granted.

 

B. No Refunds

 

You explicitly agree that once you receive access to the digital file, you will not be entitled to a refund for any reason, including but not limited to:

  • A change of mind.
  • Incompatibility of the product with your specific device (please check product descriptions carefully before buying).
  • Failure to successfully download the file within the specified time/limit.
  • Dissatisfaction with the content.

 

C. Technical Errors on Our End

 

In the rare event that the file provided is corrupted or the download link is genuinely broken through a fault on our system, we will replace the faulty file or provide a working link. You must report any such error within 7 days of purchase by contacting us at [mumbaihikers [at] gmail.com].

 

5. Limitation of Liability

 

The digital products are provided “as is” without warranty of any kind. mumbaihikers.org is not liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the digital product, including but not limited to:

  1. Any injury, loss, or damage incurred while hiking or trekking based on information in the guide. You remain solely responsible for your own safety and decisions.
  2. Damages due to incompatibility or technical faults not caused by us.

 

6. Governing Law

 

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, and any disputes relating to these terms will be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

 

7. Changes to Terms

 

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on the website. Your continued use of the site and/or purchase of digital products after any changes constitutes your acceptance of the new Terms.
